1. Acceptance of Terms

By accessing and using TXTMSG.lk SMS gateway services, you accept and agree to be bound by the terms and provision of this agreement. These terms apply to all visitors, users, and others who access or use our services.

2. Service Description

TXTMSG.lk provides SMS gateway services that enable businesses and individuals in Sri Lanka to send SMS messages through our platform. Our services include SMS API access, web portal, delivery reporting, and Sender ID management.

3. User Accounts and Registration

To use our services, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account. Registration requires valid business or individual identification as per Sri Lankan regulations.

4. Prohibited Content and Usage

SMS messages containing spam, illegal content, political content, hate speech, fraudulent material, or content that violates Sri Lankan laws and regulations are strictly prohibited. We reserve the right to monitor content and suspend accounts that violate these policies.

5. Sender ID Registration and Usage

All Sender IDs must be registered and approved before use. Sender IDs must reflect your business, product, or service name (maximum 11 characters). Generic or misleading Sender IDs are not permitted. Additional approval may be required for certain types of Sender IDs.

6. Message Volume and Rate Limits

We may impose reasonable limits on message volume and sending rates to ensure service quality and compliance with telecommunications regulations. Excessive usage that impacts service performance may result in temporary restrictions or additional charges.

7. Pricing and Payment Terms

SMS credits must be purchased in advance. All prices are in Sri Lankan Rupees (LKR) and are subject to change with prior notice. Unused credits are non-refundable. Additional taxes may apply for promotional messages as per government regulations.

8. Delivery and Service Availability

While we strive for high delivery rates, we cannot guarantee 100% message delivery due to factors beyond our control including network issues, recipient opt-outs, and handset limitations. We are only liable for delivery failures if more than 30% of messages fail due to our system errors.

9. Data Security and Privacy

We implement industry-standard security measures to protect your data. All API communications use HTTPS encryption. Message content is encrypted during transmission and storage. We comply with applicable data protection laws in Sri Lanka.

10. Intellectual Property Rights

The TXTMSG.lk platform, including its software, APIs, documentation, and trademarks, are protected by intellectual property laws. You may not reverse engineer, modify, or create derivative works of our platform without written permission.

11. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue our services with reasonable notice. You may terminate your account at any time. We may terminate or suspend your account immediately for violations of these terms or illegal activities.

12. Limitation of Liability

TXTMSG.lk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the services during the six months preceding the claim.

13. Indemnification

You agree to indemnify and hold TXTMSG.lk harmless from any claims, damages, losses, costs, and expenses arising from your use of our services, violation of these terms, or infringement of any rights of another party.

14. Compliance with Laws

You must comply with all applicable laws and regulations in Sri Lanka, including telecommunications regulations, data protection laws, and anti-spam legislation. You are solely responsible for ensuring your use of our services complies with all legal requirements.

15. Governing Law and Dispute Resolution

These terms shall be governed by the laws of Sri Lanka. Any disputes arising from these terms or our services shall be resolved through arbitration in Sri Lanka or through the Sri Lankan court system.

16. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or platform notifications. Continued use of our services after changes constitute acceptance of the modified terms.
